01. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Atlantis ("we," "us," or "our"), concerning your access to and use of our services. You agree that by accessing our services, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using our services and you must discontinue use immediately.

02. Services Description

Atlantis provides professional web design, development, SEO, and digital marketing services. Our services include but are not limited to:

  • Custom website design and development
  • E-commerce solutions
  • Search engine optimization (SEO)
  • Performance optimization
  • Website maintenance and support
  • Digital marketing consultation
  • Technical consulting

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice.

03. Payment Terms

Pricing and Invoices

All prices are quoted in U.S. Dollars and are subject to change. We provide transparent pricing with detailed quotes before work begins. Payment is typically structured as follows:

  • 50% deposit required to begin work
  • 50% due upon project completion
  • Monthly retainer options available for ongoing services

Payment Methods

We accept payment via credit card, debit card, ACH transfer, and other electronic payment methods. All payments are processed securely through our third-party payment processor.

Late Payments

Invoices are due within 15 days of the invoice date unless otherwise agreed upon. Late payments may result in suspension of services and may incur a late fee of 1.5% per month on outstanding balances.

04. Refund Policy

We stand behind our work with a 100% satisfaction guarantee. Our refund policy includes:

  • Design Phase: If you are not satisfied with initial designs, we will continue revising until you are happy or provide a full refund of your deposit.
  • Development Phase: If the delivered website does not meet the agreed-upon specifications, we will make corrections at no additional cost or provide a partial refund.
  • Post-Launch: We offer a 30-day post-launch support period. Any bugs or issues identified during this period will be fixed at no charge.
  • Third-Party Services: Refunds for third-party services (hosting, domains, premium plugins) are subject to the respective vendor's refund policy.

Refund requests must be submitted in writing via email to hello@atlantis-web.com and will be processed within 14 business days.

05. Intellectual Property

Ownership of Deliverables

Upon full payment, you will own all rights to the final delivered work, including designs, code, and content we create specifically for your project. This includes:

  • Custom graphics and design elements
  • Website code and structure
  • Written content created for your site

Third-Party Materials

Any third-party materials used (stock photos, fonts, frameworks, plugins) remain the property of their respective owners and are subject to their licensing terms.

Portfolio Rights

We reserve the right to display your project in our portfolio and marketing materials unless otherwise agreed upon in writing.

06. Client Responsibilities

To ensure timely project completion, clients are responsible for:

  • Providing all necessary content, images, and information in a timely manner
  • Responding to communication within agreed-upon timeframes
  • Reviewing and approving deliverables within specified review periods
  • Providing accurate information about business requirements and goals
  • Maintaining appropriate hosting and domain services
  • Providing access to necessary accounts and platforms (hosting, CMS, analytics, etc.)

Project delays caused by client non-responsiveness or late content delivery may extend the project timeline and are not covered by our 72-hour delivery promise.

07. Limitation of Liability

To the fullest extent permitted by law, Atlantis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services

Our total liability to you for all claims arising out of or related to these Terms or our services shall not exceed the total amount you paid to us in the twelve (12) months prior to the claim.

08. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Wyoming, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

10. Changes to These Terms
